FEDERAL FOOD, DRUG, AND COSMETIC ACT (FFDCA)
- Section 408 of FFDCA states that the EPA has the responsibility to put limitations on pesticide residues on foods.
- If the residue levels are established and the residue levels are above the limit, the goods will be seized.
- In order to set the residue levels, the EPA must prove that the levels are safe, where safe is defined as reasonable certaintly that no harm will be caused when subject to pesticide residues.
- To discover if the pesticide is safe, the EPA studies the toxicity, the break-down products, exposure to the pesticides, and risks present to infants and children.
- Exemptions may be conducted if the pesticide residues do not contain dietary risks.
